About 50 residents of Uma Sree Dream World near Kudlu Gate staged a protest at the project developer’s office on October 2, 2013, seeking completion of promised amenities.
They were demanding that the builder complete the promised amenities and fix the water leakages in the buildings immediately, besides seeking control of the common area.
“We have been seeking promised facilities like landscaped garden, club house, Jacuzzi, yoga or meditation room, billiard room, karaoke room and children’s play area and car parking areas as per approved plan that was promised by the developer at the time of purchase. Developer has reduced the parking space and tried to create extra paid carparking space to make money,” said Vinod K C, Resident who was a part of the protest.
“It has been three years after the residential block was finished. But the builder has not even bothered about these, when association raises the issues though legal notice developer tried to harass them by giving a false police complaint and filing a civil suite on us with false information,” Dr Siddapa, who was part of the protest, explained.

The project has 144 apartment units and a commercial block over 2 acres. It is located on the Hosur Main Road at the Kudlu Gate Signal Junction facing East on a plot of 2 acres 33 Guntas in Survey No. 49/1 and 49/2 in Hongasandra Village, hobli.
The set of documents shown to the buyers before the purchase included a printed colourful brochure which shows the site plan, layout plan, floor plans and the attractive pictures of several amenities.
However, the builder is said to have provided only the gym and swimming pool, nothing else. There is not even a system to harvest rain water. The residents claim that an appoximate cost difference on such a packaged sale vs. one without them would be be between Rs. 10 to 12 lakh for each apartment.
Residents reveal that as per various approvals, this plot should have at least 33% as green coverage – ie, 3833 sq metere or 41250 sq feet of land. But there is zero green cover, with the complete concretisation of the entire area.
Despite raising the issue with the builder on many occasions, the buyers found no solution. finally the residents came to know that the builders had intended to extend parking arrangements for commercial block to the parking area of the residential block, but showed it as belonging to residential block in the plan, as otherwise they would not get the approval.
It also came to light that the borewells dug were not up to the standard and went dry soon, forcing the residents to buy water from tankers. Water leaks on walls, poor quality of swimming pool and electrical short circuits are the other problems that trouble the residents.
The builder continued to work as the president of the residents’ association. When the residents came to know about the irregularities, the builder was made to resign from his post.
A legal notice issued by the apartment residents’ assoication gt a reply from the builder who continued to promise that the promised amenities would be provided within a month or two.
The builder simultaneously pleaded the association to accept alternate club house and amenities to be built illegally on the terrace. He assured that he would get it regularised through the ‘Akrama Sakrama’ scheme to be introduced by the government. This again came with a rider that the builder duo should be permitted to build pent houses for them with no objections by the association.
The Uma Sree Dream World Residential Apartment Owners Welfare Association is not formed under Karnataka Apartment Owners’ Act, but under the Societies Registration Act 1860. This is only one example of the way housing business is conducted in Bangalore, and a lesson to be studied by all those who intend to buy apartments.
